Abstract:
Papers of H.J. Biberman, a stage and screen producer-director-writer, and Gale Sondergaard, Academy Award-winning actress. The collection concerns the couple's professional careers as well as the anti-trust litigation which resulted from Biberman's attempt to mitigate the blacklisting he experienced as one of the Hollywood Ten (Independent Production Company v. Loews et al.). Documentation about the Hollywood Ten is limited, although there are autobiographical references to this period, some records of the Committee to Free the Hollywood Ten, the film The Hollywood Ten, and personal letters written by Biberman while he was imprisoned for contempt of Congress. Scripts for plays and motion pictures produced, directed, or written by Biberman or acted in by Sondergaard comprise fifteen boxes. Among the most prominent of the productions documented in his files are Green Grow the Lilacs, The Master Race, New Orleans, Roar China, Salt of the Earth, and Slaves. Sondergaard's files also include playbills, stills, and microfilmed scrapbooks. For her early career there is documentation concerning work with Melvyn Douglas as a member of the Bonstelle Company. Biberman's files also include extensive unproduced and unpublished writings including scripts, speeches, nonfiction, and several complete drafts of the autobiography eventually published as Salt of the Earth. For Sondergaard there are autobiographical fragments. Thirty-three boxes contain legal papers presented by the attorneys for the unsuccessful suit against the production companies, distributors and the theatrical union that blocked American release of Salt of the Earth, the film about the International Union of Mine, Mill, and Smelter Workers Biberman directed with Paul Jarrico and Simon Lazarus. Along with correspondence, depositions, transcribed proceedings (available only on microfilm), research material, and exhibits, there are files on other blacklisting suits brought by Dalton Trumbo, Michael Wilson, Nedrick Young, the Screen Writers Guild, and others. Other individuals represented within the legal material gathered here are Oscar Hammerstein II, Edgar Y. Harburg, Kim Hunter, Richard Rodgers, Dore Schary, as well as Roy Brewer and Richard Walsh of International Alliance of Theatrical Stage Employees and representatives of the American Legion, the Motion Picture Industry Council, and the Association of Motion Pictures Producers. Research material gathered for the suit includes scripts and financial and production records for Salt of the Earth information on Howard Hughes; autobiographical statements of blacklisted individuals in the motion picture industry; and correspondence of the Joint Anti-Fascist Refugee Committee, the National Council of American-Soviet Friendship, the National Federation for Constitutional Liberties, and other organizations investigated by HUAC.

Biography/History

Born in Philadelphia on March 1, 1900, Herbert J. Biberman was the son of Jewish immigrants from Czarist Russia. He attended private school in Philadelphia and graduated from the University of Pennsylvania before joining his father's clothing firm. Convinced that the business world was less congenial to him than the theatre, Biberman went to Yale in 1925, where he studied drama with George Pierce Baker and received an M.A. in 1927.

Herbert Biberman and his artist-brother, Edward, combined a grand tour of Europe with a year's study. Biberman stayed in Paris briefly, and then, attracted by its experiments in post-revolutionary and state theatre, he went on to study in Moscow. After returning to the United States in 1928, Biberman joined the New York Theatre Guild. There he gained considerable recognition as a director. He directed the actress Gale Sondergaard in many Theatre Guild plays, and they were married during the production of Red Dust. About 1933 he seized the opportunity to move to Hollywood to begin a short but illustrious career as a film director.

During the 1930's Biberman became progressively more involved in political activities. He supported the Committee for Loyalist Spain, the Anti-Nazi League, the Committee for Roosevelt, and the Los Angeles Chapter for Russian War Relief and he spoke at a number of West Coast rallies. In the red scare following World War II, he testified before the House Committee on Un-American Activities as one of the Hollywood Ten. His refusal to answer questions concerning past Communist affiliations led to his conviction and imprisonment for contempt of Congress.

After serving his term in federal prison in 1951, he helped form the Independent Production Company, by which he and other victims of the movie industry blacklist hoped to make films for the American market. However, their most ambitious production, Salt of the Earth, received only a limited American showing although it won honors abroad. Unable to find work with the major film companies and unsuccessful as an independent, Herbert Biberman became a housing developer in Beverly Hills. His final film was the 1969 release The Slaves which he wrote and directed. Biberman died of bone cancer on July 1, 1971.

Edith Gale Sondergaard was born to Danish parents in Litchfield, Minnesota on February 15, 1901. She attended school in Philadelphia and Minneapolis, and in 1921 she earned a degree from the University of Minnesota, where she was also active in university drama and summer stock productions. After graduation she toured the Northwest with a Shakespearean troupe and then joined the Bonstelle Company of Detroit. In 1923 she played with Milwaukee's Garrick Theatre. Attracted by the reputation of the Theatre Guild she moved to New York City and her first “break” came when she played Nina in the 1929 production of Strange Interlude. While with the guild, she met and worked with Herbert Biberman whom she married in 1930.

Although acclaimed as one of New York's finest young actresses, Gale Sondergaard retired in 1933 when her husband moved to Hollywood as a film director. Two years later Mervyn LeRoy persuaded her to play her first screen role as Faith in Anthony Adverse. For this part she won the first Oscar for best supporting actress. In succeeding years Sondergaard acted in many films including Blue Bird, Christmas Holiday, Juarez, Life of Emile Zola, and Anna and the King of Siam, and at one time she was one of the most recognizable faces on the screen. In 1946 she received an Oscar nomination for her role in Anna and the King of Siam.

Like her husband, Gale Sondergaard was active in political and social causes. In 1947 after her husband was called to testify before HUAC and then blacklisted Sondergaard also found employment scarce. In 1951 she was called to testify before the committee and at this time her film work ended completely. During this period she returned to the theatre, and she was active in many touring productions. In 1976 she returned to film for a highly-praised performance in Return of a Man Called Horse. Gale Sondergaard died on August 14, 1985.

Scope and Content Note

The papers are divided into two series: GENERAL PAPERS and SALT OF THE EARTH LITIGATION RECORDS. The GENERAL PAPERS consists of correspondence, scripts, speeches, microfilmed biographical scrapbooks, and other material relating to their joint and separate personal and professional lives. The SALT OF THE EARTH LITIGATION RECORDS consist of files donated by the law firm which represented Biberman's Independent Production Company in its anti-trust litigation IPC v. Loew's et al.

The Biographical material includes summary biographical information such as clippings and interviews about Biberman, his brother, and Gale Sondergaard. This section includes several scrapbooks about their careers, now available only on microfilm, and candid photographs and stills. Of special interest here are the scrapbooks concerning Sondergaard's acting with the Bonstelle Company in which she appeared in many productions with Melvyn Douglas.

The Correspondence is divided into general and personal material, the personal consisting of letters exchanged between the Bibermans and their family. These letters reflect their family, political, and social interests and there are many letters written by Biberman during the period he was imprisoned. The general correspondence is quite fragmentary, although there are many letters dating from the early 1950's when Biberman was working on Salt of the Earth. Prominent correspondents here include George P. Baker, Ring Lardner, Jr., Corliss Lamont, Sinclair Lewis, Albert Maltz, Carl Sandburg, and Dalton Trumbo.

There are separate files on the professional careers of both Biberman and Sondergaard. Each of these files is subdivided by genre, with individual production files arranged alphabetically by title. Gale Sondergaard's acting files for theatre, film, and television are strongest for her later career when she primarily worked as a character actress. The earlier documentation is largely comprised of stills which are now available in the WCFTR Title File. Some files include mimeographed scripts (a few with her handwritten notes) and playbills. Sondergaard's files also include political speeches she delivered and chapters for an uncompleted autobiography. This draft is quite rough and primarily covers her early theatrical and motion picture career, and it is unlikely that this is the 400-page draft referred to by Sondergaard in a 1977 interview.

Biberman's professional files include not only scripts that he directed, either for motion pictures or the stage, but also variant drafts of scripts that he wrote. In fact, the majority of the scripts in the collection consist of such plays and screenplays, some even dating to his days as a student at Yale University. Only a few items in the professional files relate to Biberman's directing technique; among them are movement charts for Roar China, as well as an outline and a script that he compiled for that production and handwritten notes pertaining to Green Grow the Lilacs.

In addition to mimeographed scripts for a few motion pictures that Biberman directed during his early Hollywood career (most notably The Master Race and New Orleans) there are also a few screenplays in the papers for motion pictures that Biberman developed. Documentation is most extensive for Slaves. (Several additional drafts for Slaves and other unproduced screenplays on which Biberman collaborated with Alida White Sherman are documented in a small WCFTR collection that is catalogued under her name.) The files on Salt of the Earth that were received directly from Biberman are relatively incomplete and disappointing, perhaps because much of the material that was originally in his custody as director of the production was removed for use as evidence in the litigation. Included in this section of the collection is a mimeographed editing script, stills and candid photographs, publicity, and some correspondence and financial records concerning the showing of the film during the 1970's.

Biberman's nonfiction writing is represented by several drafts of an autobiography that was eventually published as Salt of the Earth, essays, short stories, and speeches. For one version entitled "Director's Notes" that was unpublished in the United States there is a copy of the Chinese publication.

Other than scattered references in the correspondence and the draft autobiography the GENERAL PAPERS portion of the collection contains only a small quantity of material relating to the Hollywood Ten. In the Hollywood Ten file itself is some correspondence of the Committee to Free the Hollywood Ten that was signed or received by Edward Biberman and Tiba Willner, financial records, and publicity. This correspondence includes exchanges with attorneys Kenny and Morris and others related to the attempt to secure a pardon for Biberman. There are also numerous routine letters about finances and detailed information on 1951 expenditures and disbursements for both for the general Ten defense and for the special Family Fund. Also listed here is the film about the Hollywood Ten which was produced in 1950 by the National Council of Arts, Sciences, and Professions.

The SALT OF THE EARTH LITIGATION RECORDS are files received from Arthur Galligan and Ben Margolis who were the attorneys for IPC in Independent Productions Corp. v. Loew's et al. IPC's first production was a film called Salt of the Earth which was written by Michael Wilson, directed by Biberman, and filmed on location in New Mexico in 1953 with the cooperation of the International Union of Mine, Mill, and Smelter Workers. This film was a fictionalized version of an actual miners' strike which occurred in 1952, and many of the union's members appeared in the cast.

During its production the film was attacked for its Communist influence, and partly as a result, efforts were made by the major film companies such as RKO and Loew's Inc. and by the theatrical unions (IATSE) to prevent the film's completion and distribution. This effort was largely successful, and although Salt of the Earth won prizes abroad, its distribution in the United States was limited.

Out of this alleged conspiracy grew the anti-trust case initiated by IPC in 1956. The case was eventually lost in 1964 when the plaintiffs were unable to prove that the defendants had engaged in a conspiracy to prevent production and distribution.

These records consist of extensive legal documentation from the New York offices of Arthur Galligan and the Los Angeles offices of Ben Margolis. Because the two sets of files contained a great deal of duplication they were combined and weeded in the Archives. While the majority of the remaining material in this portion of the collection consists of legal documents and information relating to the development of the case there are also scripts, production and financial records, correspondence, and other records relating to the production and distribution of the film and to the lives of individuals involved. Because much of this material was collected to be used as evidence it is organized here as it pertained to the suit and not as it related to the production of Salt of the Earth.

The chronologically-arranged legal correspondence comes from several sources, although the majority appears to have originated in the Los Angeles files of Ben Margolis. The early coverage is very incomplete, with the years 1956-1957 and 1964 being the most extensively documented. Represented are not only Margolis, but also attorneys Martin Popper, Charles Katz, George Brussel, Jr., and Arthur Galligan, as well as Biberman, Jarrico, Lazarus, Maltz, and various other individuals involved in the making of Salt of the Earth. While the majority of the letters concern points of law and the development of the anti-trust case, there are also many references to other topics and to some personal matters. The documentation of Biberman's involvement in the case is notable, suggesting a very active role for him in the litigation.

The trial proceedings consist of stenographer's transcripts, mainly 1961-62 and 1964, together with transcripts of several conferences and hearings that took place in judge's chambers. An index to the witnesses and their accompanying exhibits precedes the file. The trial and hearing transcripts are only available on microfilm.

The material entitled “litigation books” consists of several numbered sets of pleadings and some related exhibits prepared by the attorneys for the plaintiffs. The purpose of these books is not clear, although it is known that they contain only a portion of the legal documents prepared in the course of the litigation and that several documents also appear elsewhere in the collection. Legal documents not found in the litigation books have been arranged alphabetically by title or by type. The chief exception to this are the depositions and the exhibits which have been separately arranged because of their volume.

The affidavits and depositions are arranged together alphabetically by name. The depositions, some of which are quite lengthy, are extremely useful historical documentation. In addition to the transcribed statements, several of the files contain some or all of the numbered exhibit sets which were entered into the record as part of the testimony or which were referred to during the deposition. The deposition file is not complete, although it includes some statements of witnesses for both the plaintiffs and the defense. Included are depositions by Roy Brewer and Richard F. Walsh of IATSE; representatives of the Motion Picture Industry Council, the Association of Motion Picture Producers, the American Legion; and several studio executives. Evidence was also presented in this way by Edgar Y. Harburg and Dore Schary. Unfortunately, the deposition of Paul Jarrico, a key witness, was not received by the Archives, although a virtually complete set of exhibits which accompanied his statement is present.

The exhibits are divided into files for the defendants and files for the plaintiffs. Some of these general exhibit files are incomplete. This condition may be explained in part by the fact that documentation was removed and renumbered to accompany particular witnesses' statements (i.e. Jarrico exhibit 1). In other cases, however, material marked in that way was returned to the general exhibit file. Among the material included in the exhibits files are two outlines by Michael Wilson (Box 48), Biberman's annotated directing script (Box 50), a complete file of filming roll reports, financial records, publicity, clippings, and correspondence. Also placed here is an incomplete, unidentified exhibit file. Particularly interesting in these exhibits are the reports of writer Elizabeth Poe on her interviews with numerous blacklisted writers and actors.

The research material consists of documentation collected by the two lawyers that related in some way to the development of the case. Included here are materials relating to IPC and Salt of the Earth particularly the efforts to distribute and publicize the film at home and abroad. This section also includes minutes and by-laws and miscellaneous financial records of the company. Also of interest here is the file relating to investigation of Howard Hughes' role in the case, some material pertaining to Biberman, and a file entitled “Research notebook” which contains background information on several defendants and information on the development of legal strategy. Also placed with the research material, although its role in the IPC case is unexplained, is a file of transcribed records of several organizations investigated by HUAC such as the Joint Anti-Fascist Refugee Committee, the National Council of American-Soviet Friendship, and the National Federation for Constitutional Liberties.

A large portion of the SALT OF THE EARTH LITIGATION RECORDS consists of documentation on related cases. This material was apparently gathered by the two law firms either for reference in IPC v. Loew's or because they also worked on the cases in question. (Some of the material of this type originally in the collection--especially the documentation on Pollock v. MPAA--has been removed to other more appropriate collections held by WCFTR.) These files are arranged alphabetically by name or key word. Among the individuals who figured in the represented cases were Dalton Trumbo, Michael Wilson, and Nedrick Young, as well as the Screen Writers Guild. Other individuals represented within the legal material gathered here are Oscar Hammerstein II, Richard Rodgers, and Kim Hunter.

Scope and Content Note: Addition consisting of copies of extracts from Federal Bureau of Information files on Herbert Biberman, the moving picture Salt of the Earth, and the company that produced it, Independent Productions Corporation, obtained by James J. Lorence under the provisions of the Freedom of Information and Privacy Acts between 1988 and 2001 while undertaking research for his book The Suppression of "Salt of the Earth": How Hollywood, Big Labor, and Politicians Blacklisted a Movie in Cold War America (Albuquerque: University of New Mexico Press, 1999). As usual with such copies, access to many pages requested was refused (these pages are replaced by a standard form indicating which clauses of the acts justified the refusal), and large parts of many released documents have been blacked out.
