Papers, mainly 1873-1915, of Ginzburg, an author, journalist, and publisher, solely
consisting of material related to research on Anthony Comstock and the New York Society for
the Suppression of Vice. It contains research notes; copies of material gathered for
research, such as newspaper articles, arrest blotters, and bibliographies; and some original
materials, including correspondence, interview transcripts, and photographs. Comstock
(1844-1915) was an anti-vice reformer and the main proponent of the 1873 federal laws,
commonly known as the Comstock Laws, which ban obscene publications from the mails. Included
in the collection are many original files of Theodore Schroeder, a civil liberties lawyer, a
founder of the Free Speech League, and defender of many people prosecuted under the Comstock
laws. The collection also contains the arrest journal, 1940-1942, of Harry Kahan, an agent
for the New York Society for the Suppression of Vice. This collection documents the work and
procedures of the New York Society for the Suppression of Vice and later anti-vice
societies; the personality and background of Anthony Comstock; and the effect anti-obscenity
laws had on those prosecuted, those doing the prosecuting, and society at large. There is
also some information on John Sumner, who followed Comstock as director of the New York
Society for the Suppression of Vice. Prominent correspondents and persons documented in the
collection include De Robigne M. Bennett, Ida Craddock, Edward Foote, Emma Goldman, Moses
Harman, Ezra Heywood, Ben Reitman, Margaret and William Sanger, George Bernard Shaw, Upton
Sinclair, Lincoln Steffens, and activists in the Free Thought movement. The papers also
document Comstock's efforts to suppress abortion, contraceptives, gambling, and many works

Biography/History
Ralph Ginzburg was born in Brooklyn, New York on October 28, 1929. He received his B.A. in
journalism from the City College of New York and pursued graduate studies in American
literature at Brooklyn College. He served in the United States Army from 1950 to 1951,
during which time he worked for the Public Information Office.
During the 1950s Ginzburg had many different jobs in the field of journalism including:
copyboy, reporter, and rewriteman for the New York Daily
Compass and the Washington Times-Herald;
circulation-promotion chief for Look; editor for Esquire; and freelance writer for Reader's
Digest, Collier's, and Saturday Evening Post.
In the 1960s Ginzburg began working as an independent publisher of several periodicals,
including Eros, Fact, Avant-Garde, Moneysworth, American Business, and Better
Living. He is perhaps most famous for the controversy surrounding Eros, an
expensive, hardcover publication which billed itself as a “quarterly devoted to the
subjects of Love and Sex” for the “American intellectual community.” The
first issue was published in 1962, and only four issues appeared before Ginzburg was forced
to stop publishing due to charges brought against him under various anti-obscenity laws. His
case made its way to the United States Supreme Court, and it is considered one of the
Court's landmark decisions on First Amendment Rights. On March 21, 1966 the Supreme Court
upheld Ginzburg's conviction on obscenity charges for sending three publications through the
mail. These three publications were Eros, The Housewife's Handbook of Selective Promiscuity, and Liaison, a biweekly newsletter. In their opinions, several
justices stated that Ginzburg was convicted not only because of the content of his
publications, but because of the way those publications were produced, sold, and publicized
by appealing to people's “prurient interests.” Ginzburg received a three-year
sentence, which he began serving in 1972. He was released on parole eight months later.
Besides working in the newspaper and magazine industries, Ginzburg wrote several
books. These include An Unhurried View of Erotica, 1958;
100 Years of Lynching, 1962; Eros on Trial: A Portfolio of the Most Beautiful Art from Eros, 1966; Castrated: My Eight Months in Prison, 1973; and I Shot New York, 1999.
In later years Ginzburg worked as a photojournalist. In the middle 1980s he did freelance
work for several New York newspapers and national and foreign magazines, including Time, Newsweek, and People. He also worked as a staff photographer for the New York Post. During the 1990s his photography focused on
birds.
In the 1950s Ginzburg began writing a book on Anthony Comstock which was never completed.
Comstock, born in 1844, was a reformer based in New York. He was the main proponent of the
1873 federal laws, commonly known as the Comstock Laws, which ban obscene publications from
the mails. The federal laws also inspired similar state laws in 22 states. The laws
originally were aimed not only at pornography, but at literature, abortion and sex education
information, and gambling. After passage of the laws, Comstock served as an unpaid postal
inspector and was a founder and secretary of the private New York Society for the
Suppression of Vice. In these roles he and the agents employed by the Society raided homes
and businesses, confiscated and destroyed tons of material, and sent hundreds of people to
jail. The people prosecuted included publishers, authors, gamblers, and abortion providers.
Comstock also travelled to other states to help organize anti-vice societies. When Comstock
died in 1915, John Sumner took over as secretary of the Society. In 1947 the name of the
Society was changed to the Society to Maintain Public Decency. It folded in the
mid-1950s.
Comstock and the Society generated a great deal of opposition. This opposition became
especially fierce when Comstock began targeting art and literature. Many of these opponents
were in the radical Free Thought movement, which tended to advocate atheism, secularism,
free love, women's rights, and labor rights. Comstock tried to prosecute many Free Thought
activists, including D.M. Bennett, Moses Harman, Ezra Heywood, and Emma Goldman. Several of
these activists hired Theodore Schroeder to represent them. Schroeder was a lawyer and
author who promoted freedom of expression. He was also a founder and attorney for the Free
Speech League, an organization whose work included speaking on behalf of free speech issues
and funding appeals in free speech cases.
Ralph Ginzburg died in New York on July 6, 2006.
Scope and Content Note
The Ralph Ginzburg Papers, 1848-1964, consist of three series: THEODORE SCHROEDER FILES,
WRITINGS, and RESEARCH FILES. The bulk of the collection consists of material Ginzburg
collected while researching a never published book on Anthony Comstock, an anti-vice
crusader. Much of the material consists of copies, not original source material. Ginzburg
collected the copies and the original material from a variety of sources. It is often not
noted where items came from, but it is likely that Ginzburg was the first researcher to have
access to much of the original material. The bulk of the material dates from 1873 to 1915,
and documents the activities and cases of people brought to trial under the federal
anti-obscenity laws (”Comstock laws”) of 1873.
The THEODORE SCHROEDER FILES were originally collected by Schroeder, a civil liberties
lawyer and a founder of the Free Speech League. It appears that Arnold Maddaloni, a friend
of Schroeder's, gave this material to Ginzburg. The series consists of correspondence,
photographs, newspaper clippings, and near-print material about and by people and
publications in which Schroeder was interested. The vast majority of these people were
brought to court under anti-obscenity laws, but there are also files for people who merely
wanted Schroeder's advice on how to avoid prosecution, and on people who were active in the
anti-obscenity movement. These files document well the effect that arrest under obscenity
charges had on people, especially the harassment they received from their neighbors and the
press. They also discuss the manner in which anti-vice workers dealt with suspected
violators of the law and their families. The series also provides researchers with an idea
of the wide variety of publications and other works targeted by anti-vice societies. Several
of the folders contain examples or excerpts of these works. The activities of and
communication between members of the turn-of-the-century radical movement, including Emma
Goldman, Moses Harman, Ezra Heywood, and Margaret and William Sanger, are also well
documented in this series.
The series is arranged alphabetically by name of person or publication. A few folders
contain information on two or more people. In these instances, all the material is filed
under the person whose name comes first alphabetically, although all parties are listed in
the folder title. Several folders at the end of the series contain information on
miscellaneous and unidentified cases, and one folder appears to be a draft of an article or
speech by Schroeder in which he denounces the Comstock Laws.
The WRITINGS series contains very early drafts of Ginzburg's never-published book on
Anthony Comstock. There are drafts for the first three chapters of the book and several
unidentified pages. In the drafts, Ginzburg mainly discusses early convictions under the
Comstock Laws, and Comstock's personality and psychology.
The RESEARCH FILES contain material Ginzburg collected for background information when
researching his book. It includes his correspondence, original and photocopied articles from
newspapers and magazines, citations, Ginzburg's notes, photographs, copies of portions of
the arrest blotters of the New York Society for the Suppression of Vice, and partial
transcripts of interviews Ginzburg conducted. Many of the citations are handwritten on note
cards. Most of these probably were created by Theodore Schroeder. The folders listed under
“Targets of Comstock laws” complement the THEODORE SCHROEDER FILES, as the two
series contain information on many of the same people and events.
Some of the most valuable material in the series is the interview transcripts and
correspondence scattered throughout the files. These often document the feelings and
attitudes of people who worked for or were active in the New York Society for the
Suppression of Vice. They also contain the views and reflections of relatives of Society
employees that document how the Society affected their lives. Interviewees and
correspondents often comment on how their views have changed since the days when they worked
for the Society.
Of special note in this series is the material related to Harry Kahan, an agent for the
Society. These folders contain Kahan's arrest journals for the years 1940 through 1942. In
these journals he meticulously recorded the time, date, and place of every arrest, and
biographical information about the person arrested. This journal also documents the way
Society agents performed their daily work because Kahan often recorded his activities before
and after each arrest.

diaries, writings and other material related to his work with the New York Society for the
Suppression of Vice.
