Abstract:
Closed investigative files of complaints, most of which resulted in a hearing and disciplinary action. Files include investigation reports, departmental memos, correspondence, hearing transcripts, exhibits, motions, briefs, attorney notes, findings of fact, newspaper clippings and other related materials. Many of the cases in these files concern the dispensation of controlled substances without a prescription and therapeutic substitution, whereby a pharmacist dispenses a drug other than the one prescribed. Other files contain materials about manufacturer licensing, alleged violations of the rules of professional conduct, the advertising of drug prices, operating a pharmacy without a license or without a licensed practitioner, and other violations of pharmacy law. Some files include materials pertaining to actions taken against practitioners in criminal court and legal cases where challenges were made against the board's right to discipline, state statutes, or pharmacy law.
