Abstract:
Files of attorneys dealing with activities involving nursing homes for 1976-1978 and in all department programs from 1978 to the present. Records include research notes, policy statements concerning pertinent programs, correspondence concerning legal advice, notes from staff meetings, correspondence concerning rules, and copies of old forms.

Scope and Content Note: Subject files, 1992-1998, of Linda Nichols, an attorney who specialized in issues related to nursing homes and long term care. Included are rules revision files and informal legal opinions on a variety of issues prepared for the Bureau of Quality Control and others in the Department of Health and Social Services. In addition, there are background files for a department-wide rules review which took place on Nichols' responsibilities for litigation. Approximately one fourth of the materials pertain to Nichols' responsibilities for litigation, most notably the Park Manor Nursing Home in Park Falls, Wisconsin. The documentation of this case contains personally-identifiable information and is confidential. The records include correspondence, briefs and pleadings, tape recordings of proceedings, depositions, and detailed statements of deficiency. There are also transcripts of taped proceedings of a hearing regarding the Sannes Skogdalen Home, although there are no other hearing records. Records other than the Park Manor case are not confidential. Audio recordings have been assigned call number Audio 1908A/1-9.

The Neil Gebhart files contain almost exclusively correspondence, both internal to the department and to outside parties, regarding the administration of Medicare programs in various Wisconsin counties.
