Landmark cases are those that are determined to be of historical value. Any type of case (Chapter 196. Wis. Stats.) can be landmark, if it is precedent setting, of special public interest, or of research value. Only legal counsel or Public Service Commissioner's office may select landmark cases for inclusion in this series. The following types of cases are landmark: major transmission lines, pipelines, and original construction of power plants; all holding company files, and telephone reorganization files, per Wis. Stat. 196.79; and all Necessity and Convenience case files that document the formation of a utility.

Scope and Content Note: Cases, 1990-1993, concerning the Milwaukee Metropolitan Sewerage District (MMSD) changing its method of charging municipalities for the recovery of the capital costs of MMSD's sewerage processing and water pollution abatement facilities. The municipalities involved receive sewerage services from MMSD, but they are located outside MMSD's statutory boundaries. MMSD attempted to change from a usage based formula to a property value based formula.

Scope and Content Note: Records, 1989-1999, for several court cases concerning Wisconsin utilities considered to be landmark decisions because of their rulings on the authority of the Public Service Commission (PSC). Of more general interest is a case successfully brought by Wisconsin Power and Light against the PSC after the commission ordered a lump sum penalty paid to ratepayers because of imprudent management. One commission case, 98-CV-682, apparently not appealed to court, concerns a dispute between the Eau Claire Electric Cooperative and Northern States Power Company concerning extension of lines.
