Biography/History

The Legislative Council staff operates the Rules Clearinghouse which acts as a clearinghouse of rule drafting and cooperates with the agency and revisor to review the proposed rule to ensure it meets state guidelines. For example, it is reviewed to ensure that the agency has the statutory authority to promulgate the rule; that the rule is written in proper form, style, and clear language; that it does not conflict or duplicate existing rules, etc. (see Ch. 227.15[2]). The proposed rule is then sent to the appropriate legislative standing committee. The Rules Clearinghouse assists standing committees in their oversight of rulemaking. If a standing committee objects to a proposed rule, or portion of a rule, it must be referred to the Joint Committee for Review of Administrative Rules which may uphold or reverse the standing committee's action. If it concurs with the objection, it introduces bills concurrently in both houses to prevent promulgation of the rule. If either bill is enacted, the agency may not adopt the rule unless specifically authorized to do so by subsequent legislative action. If the joint committee disagrees with the objection, it may overrule the standing committee and allow the agency to adopt the rule, or it may request the agency to modify the rule. The joint committee may suspend a rule after holding a public hearing but only under certain specified conditions. If the legislature fails to act at any point in the process the rule goes into effect. For additional information see Administrative Rules Procedures Manual.

Part 1 (Series 2027): Original Collection, 1978-1989
Physical Description: 30.8 cubic feet (77 archives boxes) 
Scope and Content Note: This series consists of a file for each proposed rule, arranged by rule number, e.g. 78-1 which is the first rule proposed in 1978. Each rule file contains, at the minimum, material required under s.227.14(2): an analysis by the agency of the rule, a reference to any forms noted in the rule, and an estimate of the fiscal impact of the proposed rule. All files also contain the Clearinghouse's report to the agency of their review. About 1/4 of the files contain a record of committee action; public hearing testimony and written comments; and occasional correspondence between legislative committees and agencies. Each file includes a “jacket” on which the history of the bill is recorded (e.g. date received by Legislative Council; date report sent to agency; if hearings held, date and place; if executive session held, final action).
Note
: When the proposed rule is introduced in each house, the archives receives a rule file from the Senate and from the House for each rule. In general, each file is identical. During processing, duplicate material is discarded and remaining documents combined into one of the jackets. Additional notes on processing procedure are filed with the Processing Room's copy of the register.
