Part 19 (2006/161): Additions, 1988-1993 16.0 cubic feet (16 records center cartons) : Cases litigated by the Department of Justice, 1988-1993, that are considered to be of historical importance. The majority of the records in this accession concern Native Americans. Most important is Lac Courte Oreilles v. Department of Natural Resources, an important episode in the opposition to the Flambeau mine in Northern Wisconsin, and Lac du Flambeau v. State, a landmark case appealed to the United States Supreme Court that established policy for Indian gaming in Wisconsin. The Lac Courte Oreilles v. the Department of Natural Resources case concerns a suit brought by Native Americans and the Sierra Club against the DNR to halt mine construction by the Flambeau Mining Company. The plaintiffs charged that the department had not enforced environmental standards during the permitting process. Included are pleadings and briefs, Circuit Court transcripts, and a supplementary environmental impact statement. The Lac du Flambeau gambling case consists of a large numbered file of correspondence, reports, and documents about tribal gaming compacts in Wisconsin; compact drafts and final agreements; depositions; legal research; and pleadings and briefs. The numbered document file can be accessed by printouts of the department's computerized document management system, which is also included in the accession. Not all numbered documents from the document management system are included, but this information is partially covered by a second set of documents in the accession which, while unnumbered, covers the gap. Also of interest are the files on Bruce Brenziger, a 16 year old whose murder prosecution case was tried in adult court because of the brutality involved, and an investigation (not a legal case) of the Wisconsin State Lottery. The study was undertaken to determine if the lottery's informational materials exceeded the constitutional ban on advertising. The records include information on the activities of McDonald Davis, the advertising firm hired by the Lottery, and examples of printed information distributed to Lottery retailers. Posters and other graphic items and radio and television ads collected by the Department of Justice have been separated to the Lottery records.
