Scope and Content Note

Files from all phases of the case consisting of legal briefs, research, correspondence, trial manuscripts, and exhibits created by the offices of the various Assistant Attorney Generals that argued the case before Judges James Doyle and Barbara Crabb in Federal District Court. The records also include files concerning early treaty rights cases from the 1970s such as the Ben Ruby land rights case and the State's various legal actions against Ford, Miller, and White as well as Cecil and Leonard Peterson, all of which involved off-reservation hunting and fishing.

The Lac Courte Oreille (LCO) Band's March 1975 suit against Wisconsin Department of Natural Resources (DNR) Secretary Lester Voigt in U.S. District Court for the Western District of Wisconsin marked the beginning of the much larger LCO proceedings. In March 1976 LCO vs. Voigt and U.S. vs. Ben Ruby were combined and put before Judge James Doyle and in October 1978 both cases were decided, along with another case, in U.S. vs. Bouchard. In that decision Judge Doyle concluded that while the Presidential removal order of 1850 was not valid, the Band's off-reservation rights had been terminated by the 1854 treaty. Both the State and the LCO Band appealed this decision. The Seventh Circuit Court of Appeals in Chicago decided LCO I, or the Voigt Decision, on January 25, 1983 concluding that Judge Doyle was correct regarding the removal order but found that the Chippewa (Ojibwe) had not given up their off-reservation hunting rights in the 1854 treaty. Appeals of that decision were declined by the Supreme Court and the case was returned to Judge Doyle in December 1983 so that the extent of the treaty rights and state regulation of the rights could be determined.

The LCO case was divided into three phases (Declaratory, Regulatory, and Damages) consisting of nine main decisions (LCO I-LCO IX) as well as a series of interim agreements and other stipulations. Judge Doyle's partial summary judgment regarding the lands available to the tribes was vacated by the Seventh Circuit Court on April 24, 1985 (LCO II) and a trial was held over December 9-16, 1985 to determine the scope of the treaty rights in question resulting in LCO III, the February 18, 1987 decision that treaty rights include all the resources utilized by the Chippewa (Ojibwe) when the treaties were signed and specified what lands were open to tribal use.

Judge Doyle presided over LCO I-III until his death in March of 1987, after which Judge Barbara Crabb was assigned to the case and ruled on LCO IV-IX. The first decision of the Regulatory Phase of the case was handed down on August 21, 1987, when Judge Crabb ruled in LCO IV that the State was allowed to regulate treaty rights with the interests of conservation, health, and safety in mind. Over March 21-24, 1988, a trial was held to determine what the term “moderate” or “modest standard of living” meant with regard to the harvest of natural resources. The resulting LCO v. decision of June 3, 1988 stated that “modest living” was not a credible standard and that the ceded territories did not hold enough resources for such a living and that there was no need for allocation of limits to harvests. A trial held over October 11th and November 2, 1988 focused on the harvesting of walleye and muskellunge resulting in the LCO VI decision of March 3, 1989 that established the idea of “safe harvest” through the enforcement of tribal conservation standards. Between August 7 and 10, 1989 a trial considering the harvest of deer, small game, and other fur bearers was held and on May 9, 1990 Judge Crabb ruled in LCO VII that, as with fish, the tribes could conduct their own regulation of hunting and harvesting. There was no trial regarding the harvest of wild rice but Judge Crabb issued a stipulation in September of 1989 and the tribes agreed to continue to share the resource.

The Damages Phase of the case began after the conclusion of the Regulatory Phase and on October 11th, 1990, Judge Crabb issued LCO VIII which contended that states are protected from tribal suits under the Eleventh Amendment of the Constitution. The final decision in the case (LCO IX) considered the harvest of timber by the tribes. Judge Crabb ruled on February 21, 1991, that timber harvest was not a traditional tribal practice and accordingly the tribes were not entitled to special commercial timber rights. Following the timber decision, Judge Crabb issued her final judgment on March 19, 1991. The case was officially concluded on May 20, 1991 when both the State and the LCO Band issued statements agreeing not to appeal any of the nine LCO decisions or the final judgment.

Scope and Content Note: Cases litigated by the Department of Justice, 1988-1993, that are considered to be of historical importance. The majority of the records in this accession concern Native Americans. Most important is Lac Courte Oreilles v. Department of Natural Resources, an important episode in the opposition to the Flambeau mine in Northern Wisconsin, and Lac du Flambeau v. State, a landmark case appealed to the United States Supreme Court that established policy for Indian gaming in Wisconsin. The Lac Courte Oreilles v. the Department of Natural Resources case concerns a suit brought by Native Americans and the Sierra Club against the DNR to halt mine construction by the Flambeau Mining Company. The plaintiffs charged that the department had not enforced environmental standards during the permitting process. Included are pleadings and briefs, Circuit Court transcripts, and a supplementary environmental impact statement. The Lac du Flambeau gambling case consists of a large numbered file of correspondence, reports, and documents about tribal gaming compacts in Wisconsin; compact drafts and final agreements; depositions; legal research; and pleadings and briefs. The numbered document file can be accessed by printouts of the department's computerized document management system, which is also included in the accession. Not all numbered documents from the document management system are included, but this information is partially covered by a second set of documents in the accession which, while unnumbered, covers the gap. Also of interest are the files on Bruce Brenziger, a 16 year old whose murder prosecution case was tried in adult court because of the brutality involved, and an investigation (not a legal case) of the Wisconsin State Lottery. The study was undertaken to determine if the lottery's informational materials exceeded the constitutional ban on advertising. The records include information on the activities of McDonald Davis, the advertising firm hired by the Lottery, and examples of printed information distributed to Lottery retailers. Posters and other graphic items and radio and television ads collected by the Department of Justice have been separated to the Lottery records.

Scope and Content Note: Records, 1992-1995, concerning two related cases of first degree intentional homicide: Wisconsin v. LaShonda Mayhill and Wisconsin v. Vernon L. Walker. Convictions in both of these cases were appealed separately based on alleged misconduct of their attorneys. The Walker decision was upheld; the Mayhill decision, for which she had received a life sentence, was reversed and remanded to Kenosha County Circuit Court. Ultimately, Mayhill pleaded no contest and was sentenced to 25 years in prison. The two cases are documented by extensive transcripts of the Kenosha County Circuit Court trials and by appeals court pleadings. The involvement of the Department of Justice, which occurred solely in the Mayhill case, is documented by petitions, background memoranda, and notes for an appeal to the Wisconsin Supreme Court. The appendix to Mayhill's Appeals Court brief in Box 5 includes a post conviction investigation of Mayhill, a single mother.

Scope and Content Note: Files, 1994-2004, related to the civil rights case of Robert J. Enis v. Department of Health and Family Services. Included are correspondence, depositions, legal research, briefs, memos, and pleadings. Enis, a resident of Mendota Mental Health Institute, focused his case on Wis. Stat. 971.17(3)(c) which permitted the state to medicate persons committed after acquittal of a crime by reason of mental illness, if the state can prove to the court that such persons are not competent to refuse medication. The court ruled in Enis' favor, finding that Wis. Stat. 971.17(3)(c) was unconstitutional because it did not require a court to determine that an incompetent inmate is dangerous prior to ordering forced medication.

Scope and Content Note: Files, 1939-1998, related to the Menominee Indian Tribe of Wisconsin v. State of Wisconsin (case 95-C-0030C), a case in Western District Court, the 7th U.S. Circuit Court, and the U.S. Supreme Court related to off-reservation treaty rights. At issue was the claim of the Menominee Tribe to off-reservation hunting and fishing rights, and the Tribe's claim to rights on portions of Lake Michigan, Green Bay, Lake Winnebago, and a segment of the Wisconsin River. The records document both the original case and the appeal to the 7th U.S. Circuit Court; there is a small amount of material related to the U.S. Supreme Court's decision. There are court documents including briefs, motions, pleadings, and opinions. There is a large quantity of photocopied historical documents gathered as part of the discovery and research process. Of note in the discovery files are several interviews with Menominee Tribe members. Research files contain original reports by expert witnesses, information on other related cases including Mille Lacs Band of Chippewa Indians v. State of Minnesota, treaty research, and Menominee culture and heritage research. Also included are a variety of maps outlining reservation boundaries and natural areas in Wisconsin.

The source of most of these documents is unknown, however many likely came from the National Archives. Aside from three boxes related to the Lac Courte Oreilles, documents have an unknown order.

Scope and Content Note: Records, 1994-1997, of two cases determined to be historically significant by the Wisconsin Department of Justice. There are records of Thompson v. Jackson (95-2153-OA), a case related to the proposed expansion of the Milwaukee Parental Choice Program in Tommy Thompson's 1995-1997 biennial budget. The records related to Thompson v. Jackson are primarily briefs. Also included are records for Thompson v. Milwaukee Branch of the NAACP (95-C-1245), a case in which the plaintiffs challenged the at-large election system for trial and appellate courts, believing that this system resulted in racially based voting. Thompson v. NAACP was challenged in the 7th Circuit Court (96-3315) and the U.S. Supreme Court. Records for Thompson v. Jackson include depositions, exhibits, briefs, trial transcript, research, and working papers.

Scope and Content Note: Records, 1993-1999, related to two cases determined to be historically significant by the Department of Justice. The case of the State v. King, Dennis; DeCoteau, Simon; King, Ronald; Hill, Jordan relates to 1994 and 1995 incidents where the respondents were fishing with dip nets in Duck Creek near Pamperin Park Dam in Brown County and were cited by the State for fishing within 500 feet of a dam, the respondents moved for dismissal of the charges, claiming that the court lacked subject matter jurisdiction over members of the Oneida tribe who were fishing within reservation borders. Records include briefs, exhibits, hearing transcripts, discovery documents, research, and background materials. The second case is the State of Wisconsin v. Phillip Morris, et al., documenting Wisconsin's involvement in the multi-state tobacco lawsuit. Records include witness files, discovery documents, correspondence, settlement materials, and information about the case in other states. There is also a complete set of court documents containing pleadings, briefs, and orders. Of note are anti-smoking advertisements designed by students, and other smoking prevention materials.

Scope and Content Note: Case files (closed) from case number 99-CV-952, Monica Forgues, et al. v. Heart of Texas Dodge Inc., et al., 2004. The plaintiff, Forgues, was involved in an automobile accident that resulted in extreme injury that left her paralyzed. Parties involved in the case include Forgues, Subscriptions Plus Inc. and Karleen Hillery, Progressive Northern Insurance Company, Scottsdale Insurance Company, Acceptance Insurance Company, and National Publishers Exchange, and Heart of Texas Dodge Inc., Universal Underwriters Insurance Company, YES Inc., Choan A. Lane, Allstate Insurance Company, and Jeremy Holmes. Records include court case, appeals, and settlement documents, which consist of correspondence, notices, briefs, affidavits, exhibits, depositions, complaints, interrogatories, answers, and motions.
